MARKET TERMS AND CONDITIONS

These Terms and Conditions (the "Agreement") set forth the rules and requirements for participation in the TREASURY Market.

By attending, setting up a stall, or trading at the TREASURY Market, you (the "Stallholder") agree to comply with the following terms.

 

1. Eligibility

1.1. RUMMAGE CITY is open to individuals and businesses selling secondhand, vintage, or handmade items. All products must be legal, safe, and comply with local laws and regulations.
1.2. Stallholders must be at least 18 years of age.

2. Booking and Stall Assignment

2.1. Booking in advance must be made via this website.
2.2. Limited Availability: Stall spaces are limited and will be First Come, First Serve. Stall sites will be allocated on a first-come, first-served basis. Arriving early is recommended to secure a spot.

3. Stallholder Fees

3.1. Stallholders must pay the stall fee upon arrival at the market BY CASH
3.2. No Refund Policy: All fees are non-refundable, even if the stallholder decides to leave early or does not attend the market for any reason.

3.3. Any stall holder who fails to show up for a market, without notifying the management at least 2 before the event, will incur a cancellation fee of $30. This fee will be sent via an invoice and failure to pay this fee will result in a market ban.

3.4. The cancellation fee applies to all no-shows, regardless of the reason, unless there are exceptional circumstances (e.g., emergencies) that are communicated in advance.

4. Set-Up and Breakdown

4.1. Stallholders must set up during the designated setup times, as announced by the market organizers. Early arrivals will not be allowed to set up before the stated time.
4.2. Stallholders must remain open for the full duration of the market and cannot dismantle their stall or leave before the market closes.
4.3. Breakdown Time: All items and displays must be removed by the designated breakdown time. Failure to comply may result in penalties or exclusion from future markets.

5. Conduct and Behavior

5.1. Stallholders are expected to conduct themselves professionally and respectfully at all times. Disruptive behavior, harassment, or violations of local laws will not be tolerated.
5.2. Stallholders are responsible for maintaining their stall in a clean, safe, and organized manner. All rubbish must be disposed of in the designated bins.
5.3. Stallholders must ensure that their products are safe for public sale and comply with all applicable safety and health standards.

6. Insurance and Liability

6.1. Stallholders are responsible for obtaining their own insurance, including public liability insurance, to cover any accidents, damage, or injury arising from their stall or products.
6.2. The market organizers accept no liability for theft, damage, or loss to any items or property belonging to the stallholder during the event.
6.3. Stallholders agree to indemnify and hold harmless the market organizers from any claims, damages, or expenses arising from their participation in the market.

7. Health and Safety

7.1. Stallholders must comply with all health and safety regulations, including but not limited to fire safety, food handling (if applicable), and any other applicable laws.
7.2. If food or drinks are sold, stallholders must have the appropriate licenses and certifications.

8. Wet Weather, High Winds, and Extreme Heat Policy

8.1. Event Cancellation Due to Adverse Weather

  • The safety and well-being of our stallholders, visitors, and staff are our top priority. In the event of extreme weather conditions, including heavy rain, high winds, or extreme heat (temperatures reaching 38°C or higher), the event organizers will assess the situation and may decide to postpone or cancel the market.

  • Cancellation or Postponement Decision:

    • The decision to cancel or postpone the market will be made by the event coordinators, who will closely monitor weather reports and conditions.

    • The decision will be communicated as soon as possible, typically no later than 4 hours before the event starts. If adverse weather develops during the event, the market may be canceled or closed early for safety reasons.

8.2. Types of Adverse Weather Conditions

  • Heavy Rain: If rain becomes torrential or if there is significant risk of flooding, the event may be canceled or postponed.

  • High Winds: If wind speeds reach over 40km/h, stallholders with outdoor setups may be required to pack down early, as high winds can cause damage to equipment, marquees, and display items.

  • Extreme Heat: If temperatures reach 35°C or higher, the market may be canceled or rescheduled for the safety of participants and attendees.

8.3. Communication of Cancellation or Postponement

  • Stallholders will be notified via email, phone, or text message as soon as the decision is made to cancel or postpone the event. It is essential that stallholders keep their contact details up to date during the application process.

  • Notifications will also be posted on the event’s official website and social media channels for public awareness.

8.4. Refund or Roll-over Options

  • If the market is canceled due to weather conditions (rain, high winds, or extreme heat), stallholders will have the option to:

    • Receive a full refund, or

    • Roll over their stall fee to the next scheduled market (subject to availability).

  • No Refund for Partial Cancellations: If the market proceeds with a modified schedule or if only a portion of the event is canceled, refunds will not be issued.

8.5. Stallholders' Responsibility During Adverse Weather

  • Stallholders are responsible for ensuring their stalls are safely set up and prepared for adverse weather, including:

    • Heavy rain: Bringing waterproof coverings, tarps, or suitable shelter for their goods.

    • High winds: Ensuring that equipment and marquees are securely weighted (minimum 20kg per leg) and properly anchored.

    • Extreme heat: Taking measures to protect products from damage (e.g., bringing shade and cooling equipment).

  • Marquee Guidelines: If using a marquee, it is essential to secure it properly to avoid damage or injury during high winds. If the winds become unsafe, stallholders may be asked to pack down early.

8.6. Weather-Related Early Departure

  • If conditions become unsafe due to heavy rain, high winds, or extreme heat during the event, stallholders may be required to pack down early.

  • In case of early departure, no refunds will be issued for any stall fees, and stallholders will not be compensated for lost trading time.

8.7. Event Rescheduling

  • If the market is rescheduled due to adverse weather conditions, stallholders will be required to confirm their availability for the new date. If a stallholder cannot attend the rescheduled event, they will be offered a credit for a future event, rather than a refund.

8. Extreme Weather Preparedness

  • In case of high winds or heavy rain, stallholders should bring:

    • Secure weights for marquees and tents (minimum 20kg per leg).

    • Waterproof covers or tarps for their products.

    • A first aid kit for safety in case of accidents caused by wind or rain.

  • In the case of extreme heat (over 38°C), stallholders are encouraged to:

    • Bring plenty of water, shade, and cooling equipment.

    • Ensure products are kept in cool conditions and avoid damage from heat.

    • Use sunscreen and wear hats for sun protection.

By participating in ‘That’s Mine’ Events, stallholders acknowledge the possibility of adverse weather cancellations or adjustments and agree to the conditions outlined in this policy. Our goal is to ensure a safe and enjoyable market experience for all, even in challenging weather conditions.

9. Market Conduct

9.1. Stallholders must ensure that their products do not infringe on any intellectual property rights, including copyrights, trademarks, and patents.
9.2. The sale of illegal or counterfeit goods is strictly prohibited. Any stallholder found selling such items will be immediately removed from the market and may be barred from future participation.
9.3. Stallholders are not permitted to sell products that may be deemed offensive, inappropriate, or controversial by the market organizers.

Consequences for Violating the Code of Conduct:

Failure to adhere to the Stallholder Code of Conduct may result in one or more of the following actions:

  • A verbal or written warning.

  • Immediate removal from the event without a refund.

  • A ban from future events organized by "That's Mine" Events.

We expect all stallholders to take this code seriously, as it ensures a successful and enjoyable event for all involved.

10. Prohibited Items

The following items are strictly prohibited and may not be sold at the TREASURY Market:

  • Illegal goods: Any item that is illegal to possess, sell, or distribute under local, state, or federal law.

  • Counterfeit items: Fake or replica products that infringe upon the intellectual property rights of another person or entity (e.g., counterfeit clothing, accessories, or electronics).

  • Hazardous materials: Items that are unsafe, toxic, flammable, or otherwise hazardous, including chemicals, firearms, explosives, or anything that poses a health or safety risk.

  • Stolen goods: Any item that has been stolen or is otherwise unlawfully obtained.

  • Weapons and firearms: Any type of weapon, firearm, ammunition, or related items.

  • Drugs and drug paraphernalia: Any illegal drugs, controlled substances, or drug-related items (e.g., pipes, bongs, etc.).

  • Used or expired cosmetics: Personal care products that are used, opened, or expired.

  • Food or beverages (without proper certification): Food items that do not comply with health and safety regulations, or that are sold without the necessary licenses and permits.

  • Live animals: Unless specifically approved, live animals cannot be sold.

  • Pornographic material: Any item that is sexually explicit, pornographic, or otherwise inappropriate for a public market.

  • Pirated media: DVDs, CDs, games, software, or other media that are illegal copies or unauthorized reproductions.​

Any stallholder found selling prohibited items will be asked to immediately remove the items from their stall. Repeated violations may result in removal from the market and exclusion from future events.

11. Compliance with Local Laws

11.1. Stallholders are required to comply with all applicable local laws, regulations, and ordinances while participating in the market.
11.2. Stallholders must ensure that all items for sale are in compliance with the relevant consumer protection laws.

12. Market Cancellation

12.1. The market organizers reserve the right to cancel or postpone the event due to unforeseen circumstances (e.g., inclement weather, emergencies).
12.2. Refunds for Cancellation: If the event is canceled, stallholders will be notified, and any applicable refunds will be issued at the discretion of the organizers. However, all fees are non-refundable, and this policy applies regardless of event cancellation or changes in market conditions.

13. Photographs and Promotional Material

13.1. The market organizers may take photographs, videos, or other media during the event for promotional and marketing purposes. By participating in the market, you grant permission for your stall and products to be included in such media.
13.2. Stallholders may not use the event name, logo, or any other trademarks without prior written permission from the market organizers.

14. Changes to Terms and Conditions

14.1. The market organizers reserve the right to modify or update these Terms and Conditions at any time. Stallholders will be notified of any significant changes. It is the responsibility of the stallholder to stay informed of any updates.

15. Agreement

By arriving, setting up your stall, and trading at the TREASURY Market, you acknowledge that you have read, understood, and agree to these Terms and Conditions. You further agree to abide by all instructions provided by the market organizers during the event.

All participants in the TREASURY Market, including stallholders, implicitly agree to the Terms and Conditions upon trading.

No Refund Policy: By agreeing to these Terms and Conditions, you acknowledge that all fees are non-refundable, even if you leave early or decide not to attend the market for any reason.
